DISH Wins Lawsuit Against Popular IPTV Provider Jadoo TV

DISH and The IBCAP have successfully won a lawsuit against IPTV Provider Jadoo TV.

The IBCAP (International Broadcaster Coalition Against Piracy) comprises international broadcasters and distributors committed to combating illegal streaming worldwide.

The group includes members such as BBC Studios, Sony Entertainment, Scripps, MTV India, bein Sports, and others.

Recently, DISH Network and IBCAP collaborated to lodge a copyright complaint against IPTV Provider Jadoo TV.

The complaint, initially filed in November 2018, alleged that Jadoo TV’s CEO, Sajid Sohail, could be personally liable for direct, contributory, and vicarious infringement.

In September 2020, a California Court dismissed Sohail’s motion to dismiss the claim.

Subsequently, in March 2023, DISH and IBCAP filed a motion for summary judgment, which Sohail opposed.

District Court Judge Charles R. Breyer sided with DISH, denying Sohail’s defense and holding him personally accountable as Jadoo’s director.

Notably, Sohail is personally accountable as Jadoo’s director due to being the “guiding spirit” behind the infringement. See Bangkok, 742 F. Supp. 2d at 1114–15. As the founder, CEO, director, and majority shareholder of Jadoo, and with the authority to unilaterally adjust company policies, Sohail is found liable.

DISH is now required to submit a joint filing on the restitution Jadoo and Sohail must provide, including statutory damages, profits, legal fees, and a permanent injunction.

IBCAP, a key player aiding DISH in the lawsuit, issued a statement featuring a quote from Executive Director Chris Kuelling:

This judgment sets a precedent beyond many other copyright cases managed by IBCAP. Here, the owner and CEO of a prominent South Asian service offering pirated content cannot hide behind corporate protection and is held personally accountable for the damages arising from his and his company’s copyright infringement… IBCAP and its partners will not tolerate piracy, and once again, U.S. courts have supported us by ruling against an infringing service and making an owner personally answerable.

Jadoo TV was widely popular in South Asia and marketed set-top boxes preloaded with software for live streaming.
