India Will Require VPN Providers to Collect and Share User Data

India recently passed a new law. This requires VPN providers in the country to collect and retain user data.

These regulations mandate Indian VPN companies to log various user data. This includes IP addresses and more, for a period of 5 years.

The Computer Emergency Response Team in India (CERT-in) implemented this new law. It compels VPN companies to log data from users connected to their servers.

This encompasses customer names and physical addresses. It also includes IP addresses, usage patterns, and other information.

India’s Ministry of Electronics & IT released a press release. It highlighted these new laws and regulations that will be implemented.

A formal statement from the Indian government outlines the directives. VPN providers and others must now adhere to these.

Data Centers, Virtual Private Server (VPS) providers, Cloud Service providers and Virtual Private Network Service (VPN Service) providers, will be required to register certain info. This must be maintained by them for a period of 5 years or longer. This duration is mandated by the law after any cancellation or withdrawal of the registration.

The info is as follows: a. Validated names of subscribers/customers hiring the services
b. Period of hire including dates
c. IPs allotted to / being used by the members
d. Email address and IP address and time stamp used at the time of
registration / on-boarding
e. Purpose for hiring services
f. Validated address and contact numbers
g. Ownership pattern of the subscribers / customers hiring services

These orders are expected to take effect on June 27th of this year. However, there might be delays to accommodate further changes.

VPN services that don’t comply with these new orders and regulations may face penalties. These can include fines or even imprisonment.

Many VPN providers, such as IPVanish, might find it difficult to comply. They often have strict no-log retention policies.

It will be interesting to observe how India plans to enforce this new law. We will see it’s implications for VPN providers and users within the country.
