TorrentFreak reports that YouTuber Omi in a Hellcat (whose real name is Bill Omar Carrasquillo) is currently being prosecuted by the US government. These charges relate to his previous involvement in pirate IPTV services
Some may recall that back in 2019, Omi in a Hellcat (Bill Omar Carrasquillo) had assets seized by US authorities. This action was taken due to his operation of an illegal IPTV service.
As part of the operation against Carrasquillo, the FBI and IRS took action. They confiscated a minimum of $5.2 million from his bank accounts, in addition to seizing his collection of high-end vehicles.
This illicit IPTV service operated under various names, including Gears Reloaded, Reboot, and Gears TV Reloaded. Through these platforms, it provided access to a vast library of content including thousands of live channels, VOD options, PPV events, and more.
The US Government made a statement regarding Carrasquillo’s illegal IPTV services. They alleged that Carrasquillo’s platforms were redistributing broadcasts from Comcast, Verizon, Spectrum, DirecTV, and Frontier Communications. These activities reportedly generated a substantial $34 million in revenue for Carrasquillo.
In the early months of 2022, Omi in a Hellcat made a significant announcement. He revealed his intention to plead guilty, hoping for a reduced sentence. The government’s indictment initially suggested a potential prison term of 514 years.
As time has passed, Carrasquillo has encountered yet another legal hurdle. This time, it revolves around the “reloaded” branding associated with his IPTV services.
Reloaded IPTV Trademark Dispute
Following the downfall of his IPTV business, Carrasquillo looked for alternative avenues to generate income. He wanted to leverage his substantial online following.
Omi in a Hellcat decided to venture into the merchandise and apparel industry. His plan was to sell merchandise featuring the “Reloaded” branding, which had been linked to his previous IPTV ventures.
The website remains operational and appears to be functional. If you visit the official Reloaded Merch website, you’ll discover a range of products. They offer shirts, shoes, hats, pants, and other apparel items.
Adding to his legal woes, Omi in a Hellcat now faces a lawsuit from Nustar Enterprises LLC. The lawsuit alleges trademark infringement related to the “Reloaded” branding.
The complaint filed by Nustar highlights the trademark infringement issue. It states that NuStar’s clothing and apparel products, including the RELOADED® line, are sold in physical stores. They are also marketed, distributed, and sold online through NuStar’s ‘Reloaded’ storefront on Amazon.com.
Furthermore, the complaint emphasizes that to safeguard its rights to the RELOADED trademark, NuStar acquired and currently holds U.S. Trademark Registration No. 6,376,399. This registration falls under International Trademark Class 025 for the mark RELOADED. It covers “clothing and apparel, namely, shirts, jackets, pants, hats, belts, scarves, gloves, socks, underwear, swimwear, and wristbands.” The RELOADED® trademark was officially registered on June 8, 2021.
A review of the official US trademark registration database confirms Nustar Enterprises LLC’s ownership of the “Reloaded” trademark.
Nustar Enterprises initially attempted to resolve the matter through negotiations with Carrasquillo. However, these discussions were unsuccessful, leading Nustar to pursue legal action for the alleged “Reloaded” trademark infringement.
The company is seeking significant compensation in its lawsuit. It demands all profits earned by Carrasquillo and Reloaded Merch LLC, multiplied by three. Additionally, Nustar Enterprises is pursuing an injunction to prohibit any further usage of the “Reloaded” trademark. This injunction aims to prevent any potential confusion, mistake, or deception among consumers.
