Major film companies, including Paramount, Universal, Warner Brothers, Columbia, Disney, and Netflix, recently filed a copyright infringement lawsuit against PrimeWire. PrimeWire is one of today’s most popular movie streaming websites, with millions of monthly users.
PrimeWire implemented substantial website modifications after the lawsuit was filed in an attempt to avoid legal consequences. This included removing all links to copyrighted content. They also promised to prevent cyberlocker links from being uploaded.
The website took the step of listing ways users could stream movies and TV shows through legal platforms. This shows the lengths they went to in order to try and comply with copyright laws.
The movie companies viewed this as a tactic to keep the site operational even without access to pirated content. Overall traffic to the PrimeWire website significantly decreased after these website changes were implemented.
Since removing copyrighted movies and TV shows, the site has lost over 13 million monthly users. The film companies continued to pursue legal action against PrimeWire, and the case was eventually heard by a Federal District Judge in California.
Judge Mark Scarsi pointed out that PrimeWire’s actions and content were directed toward people in the US. He also determined that PrimeWire had violated direct copyright infringement, stating:
Defendants promoted infringement by featuring Plaintiffs’ works on the website. They curated third-party streaming links, and provided detailed instructions for rating and streaming these works.
There was no defense in this case because PrimeWire operators did not appear in court. However, after removing all copyrighted content from the website, they continued to contact the plaintiff’s legal team to argue their case.
This did not help their cause because the court determined that they had not made a compelling enough case. The court stated they had not convincingly demonstrated that they would not resume their infringing operations.
It is the burden of the party voluntarily ceasing its conduct to appear and make the strong showing it cannot reasonably be expected to restart its behavior. Defendants have not defended this lawsuit despite receiving notice and despite changing the PrimeWire website in response to the Court’s orders.
This resulted in a permanent injunction requiring PrimeWire operators to relinquish control of all website domains and other registrars to the Plaintiff.
