As initially covered by TorrentFreak, U.S. Senators Thom Tillis and Patrick Leahy have introduced the SMART Copyright Act of 2022. The term “Smart” is an acronym that means Strengthening Measures to Advance Rights Technologies.
This new copyright bill mandates online hosting providers to implement new protective steps. These will be specified by the U.S. Copyright Office.
Essentially, this has the potential to bring about significant alterations to the existing DMCA laws. These changes could be quite substantial.
Senator Thom Tillis shared his perspective on this new copyright law in an official press release. Here’s what he said:
“Currently, there’s no universally agreed-upon standard for technical measures in the fight against copyright infringement. This issue must be addressed. I’m proud to put forward this bipartisan legislation that will establish readily accessible anti-piracy strategies and foster a trustworthy and efficient internet environment for our creative sectors.”
Some may recognize Senator Tillis as the driving force behind the contentious Felony Streaming Bill. This bill was introduced in late 2020. It was later incorporated into the Covid Relief Bill..
Senator Patrick Leahy is one of the bipartisan supporters of the SMART Copyright Act. He also shared his thoughts on the new bill:
“Almost twenty-five years ago, we passed the Digital Millennium Copyright Act. This was a significant update to copyright laws for the internet era. The internet has evolved drastically since then, and copyright has changed along with it. I’m eager to collaborate with Senator Tillis, filmmakers, musicians, authors, and artists. We also plan to work with online platforms. The objective is to tackle online copyright infringement, which deprives these artists of the rewards of their creativity and effort.”
The varied reactions from different groups to this proposed copyright law are noteworthy. .
Organizations such as the Author’s Guild, Creative Future, and the Motion Pictures Association (MPA) have shown strong support. Their backing for the proposal is quite significant.
The MPA released a press release recently. They expressed the following:
“We appreciate Ranking Member Tillis and Chairman Leahy’s ongoing efforts to safeguard the creative community’s rights against digital theft. Congress envisioned that creators and online service providers would collaborate on technical solutions to protect copyrighted works when the DMCA was enacted.”
Conversely, organizations such as Public Knowledge and ReCreate have voiced their disapproval of the bill. Their opposition to the bill is quite clear.
Public Knowledge shared their views on the SMART Copyright Act in an article.. They stated the following:
“This bill could lead to widespread online censorship. Public Knowledge firmly believes that protecting copyrighted works is crucial. It’s vital for fostering creativity and safeguarding the livelihoods of creators. However, this bill jeopardizes the very principles it seeks to uphold. . It would be detrimental to a free, innovative, and culturally vibrant internet. The SMART Act, regrettably, is anything but smart.”
