As initially reported by TorrentFreak, Sling TV & DISH initiated the lawsuit in a Nevada court. The lawsuit names Las Vegas resident Santina Fulton as the defendant.

Fulton is identified as the purported owner and operator of VNest IPTV. She had previously been issued a cease-and-desist letter by the companies in October 2021.

This cease-and-desist notice was disregarded, and the service continued operating without interruption.

However, following the court filing by Sling & DISH, the official VNest website has become inaccessible.

The media companies contend that VNest captured streams from DISH Network. They then rebroadcast these streams using their own branding.

They further allege that some channels were taken from Nitro TV. Nitro TV is also currently facing legal action from DISH Network.

Many IPTV developers take extensive measures to conceal their identities. However, Fulton seems to have taken the opposite approach.

Investigators for DISH & Sling subscribed to the service and made payments. These payments, made via PayPal and Venmo, were traced directly to Santina Fulton.

The lawsuit against VNest asserts that the company breached the Federal Communications Act. Additionally, it claims a violation of the Digital Millennium Copyright Act (DMCA) through the unauthorized capture and retransmission of live streams.

DISH Programming and Sling Programming have been retransmitted to users of Defendants’ VNest TV service without Plaintiffs’ authorization, thereby allowing VNest TV users to receive such programming without paying the requisite subscription fee to DISH or Sling.
